Tolexis Trading Limited, a part of Group DF group of companies, filed a cassation appeal to the Supreme Court of Ukraine against the decision of the appeal court regarding the termination of the contract of the State Property Fund with Tolexis Trading Limited on the establishment of Zaporizhzhia Titanium and Magnesium Plant LLC.
The Cyprus company Tolexis Trading Limited, being a part of Group DF, strongly disagrees with the decision of the appeal court regarding the termination of the agreement on the establishment of Zaporizhzhia Titanium and Magnesium Combine LLC. The agreement was concluded between the State Property Fund of Ukraine with Tolexis Trading Limited. The decision of the court is politically motivated, baseless and completely negates the legitimate rights of Tolexis Trading Limited as an investor.
Group DF states that the delay by the Ukrainian courts the recognition of the Arbitration Institute of the Stockholm Chamber of Commerce decision to enforce a debt of Odessa Portside Plant to Ostchem Holding Limited company amounting over $300 million or 7.8 billion hryvnia, is a violation of the UN Convention on recognition and enforcement of foreign arbitral awards, which was ratified by 149 countries, including Ukraine.
Group DF is surprised by the decision of Zaporizhzhya region Economic Court on the termination of the contract of the State Property Fund of Ukraine with Tolexis Trading Limited company about the establishment of Zaporizhzhya Titanium Magnesium Plant LLC. Group DF considers the decision groundless and politically motivated. The Group stands assured of its rightness and will challenge this decision in Ukrainian and international courts.
Valki-Ilmenite and Mezhdurechensk MCC mining companies, which are part of the Group DF titanium business, have supported the third stage of the Ukrainian Rally Championship named Rally "CAPITAL". Competitions were held on 8-9 July in Kiev and Zhytomyr region – Irshansk town with the participation of over 30 crews from all over Ukraine. The Rally "CAPITAL" is the largest in Ukraine car competition and is held with the participation of Ukrainian and foreign teams for 19 years under a series.
In 2017, the Nika-Tera Sea Specialized Port has processed 229 vessels, handling 4.17 million tons of cargo, which is almost 4% more than in 2016.
For 11 months of 2017, three mineral fertilizers plants of Ostchem (consolidating Group DF’s fertilizer business) - Azot (Cherkasy), Rivneazot and Severodonetsk Azot - produced 1.48 million tons of nitrogen fertilizers for the Ukrainian agro-industrial complex. Thanks to support from the Government, including the introduction of anti-dumping duties by the Ministry of Economic Development and Trade towards some Russian fertilizer producers, since June 2017, Ostchem has been able to start the plants and resume fertilizer production after a long period of inactivity.
In January-November of 2017, Nika-Tera Sea Specialized Port (part of Group DF port business) processed 3.82 million tons of cargo, which is 10.3% more than the same period in 2016.
Nika-Tera Sea Specialized Port (part of Group DF port business) has entered the TOP-3 rating among all grain terminals in Ukraine based on the rating of stevedoring companies, compiled by the Ports of Ukraine edition and BlackSeaTrans information and analysis center. In particular, the terminal took the 2nd place in the category "Absolute growth of grain cargoes" based on the company's performance in 2016-2017 marketing year.
For three quarters of 2017, the Sea Specialized Port Nika-Tera LLC (part of Group DF port business) processed 3.35 million tons of cargo, which is 44% more than the same period last year. In the total volume of cargo turnover, grain transshipment amounted to 63% (2,126 K tons), bulk cargo - 32% (1,070 K tons), mineral fertilizers - 5% (156,3 K tons). Transshipment of general cargo for January-September amounted to 0.5 K tons.
